Terms of service

These terms govern your use of the marketing website at niyamis.com (the "Site"), operated by Niyamis Limited, a company incorporated in New Zealand. By using the Site you agree to these terms. If you don't, please don't use the Site.
1. What the Site is
The Site is a marketing and information resource about Niyamis - our tool-intelligence platform - and about Niyamis's consulting engagements. Nothing on the Site is a contract, an offer to contract, or a representation of what the Niyamis product will do on your specific shop floor. The only representations that bind us are the ones we sign in a separate services or subscription agreement with your company.
2. Intellectual property
Site content - articles, case studies, copy, visual design, logos - is © Niyamis Limited unless another credit is shown. You may:
- View and share links to the Site.
- Quote reasonable excerpts with attribution.
You may not:
- Republish content in bulk (more than ~200 words per page).
- Remove attribution.
- Pass off the content as your own or your employer's.
If you'd like to reuse something more substantial - for a tool-spend report, a student dissertation, an industry presentation - ask us. We almost always say yes.
3. Linked tools and external services
The Site embeds and links to third-party services (Cal.com for booking, Plausible for analytics, various social networks, external articles and data sources). Those services have their own terms and privacy policies, and Niyamis is not responsible for the accuracy, availability or content of third-party material.
4. Your submissions
When you submit information through a Site form (discovery-call booking, ROI-worksheet request, contact email), you:
- Confirm that what you submit is accurate.
- Grant Niyamis a non-exclusive right to contact you in connection with your request, and to use any non-personal feedback internally to improve our product and content.

5. No warranties on the Site
The Site is provided as is. We make reasonable efforts to keep it accurate and available, but we don't warrant that it's free of errors, uninterrupted, or fit for any particular purpose - for example, we don't guarantee that anything you read here will produce a specific result on your floor. Actual engagement outcomes are described in the agreements we sign with clients.
6. Limitation of liability
To the extent permitted by law, Niyamis's aggregate liability to you arising from or related to the Site (whether in contract, tort or otherwise) is limited to NZ$100. We don't exclude or limit liability where the law doesn't allow us to - for example, liability for gross negligence, fraud, or where the Consumer Guarantees Act 1993 applies.
7. Governing law
These terms are governed by the laws of New Zealand, and the courts of New Zealand have exclusive jurisdiction over any dispute arising under them.
8. Changes
We may update these terms. The "Last updated" date at the top always reflects the current version. Continued use of the Site after changes means you accept them. If changes materially affect your rights we'll flag them on the homepage for at least 30 days.
